These terms and conditions of sale (the "Terms") govern every sale made by Taqwa Services through taqwaservice.fr. They apply to private customers and to repair professionals alike.
Placing an order means accepting these Terms in full, in the version published on the day of the order. Please read them carefully and keep a copy: together with the order confirmation, they form the contract between us.
Some provisions below apply only to consumers within the meaning of the French Consumer Code — in particular the right of withdrawal (article 10) and the statutory guarantees (article 9). Customers buying for the purposes of a business are excluded from them by law.
1. Purpose and scope
These Terms set out the rights and obligations of both parties in the distance selling of repair parts, accessories and mobile devices.
They prevail over any other document and, for business customers, over their own purchasing terms, unless we have agreed otherwise in writing.
We may amend these Terms at any time. The version that applies to your order is the one published on the site when you place it; a later amendment does not apply to it.
If any provision of these Terms is held void or unenforceable, the remaining provisions stay in force.
2. Our product ranges and the warranty that applies
The warranty we grant depends on the type of product, so articles 5 to 8 are organised by range.
2.1 Repair parts
LCD, In-Cell and OLED screens, batteries, charging ports, flex cables, cameras, speakers, back glass and other components intended for repair.
These products carry our 90-day commercial warranty against manufacturing defects (article 5).
2.2 Service Packs
Genuine manufacturer assemblies — Samsung, Apple, Google, Xiaomi and others — supplied sealed in their factory packaging.
They are sold "as is", with no commercial warranty (article 6).
2.3 Mobile phones
Complete devices are covered by the manufacturer's warranty (article 7). We add no commercial warranty of our own.
2.4 Accessories
Cables, chargers, adapters, headphones, cases, screen protectors, hubs and tools.
Six months of commercial warranty on unbranded lines; the manufacturer's warranty on major brands (article 8).
3. Orders, prices and payment
3.1 Placing an order
You select your items, check the basket summary — references, quantities, prices and delivery costs — then confirm the order. Confirming it is an undertaking to pay.
The contract is formed when we send our confirmation email summarising the order. Until that email is sent, no sale has been concluded.
We may refuse or cancel an order in the event of a previous payment incident, an order that is abnormal in relation to usual quantities, an obvious pricing error, or unavailable stock. You will be told and refunded without delay.
3.2 Prices
Prices are shown in euros, inclusive of French VAT at the rate in force. Delivery costs are added to the price of the goods and shown before final confirmation.
The applicable price is the one displayed when you confirm the order. We may change our prices at any time, with no effect on orders already confirmed.
3.3 Availability
Our offers are valid while stocks last. If an item turns out to be unavailable after your order, we will tell you and refund the corresponding amount within fourteen (14) days of that notice.
3.4 Payment methods
Payment is made by bank card, by transfer, or by any other method offered at checkout. The full price is due when the order is placed.
Card payments are handled by an approved payment provider over an encrypted connection. No card number is stored on our servers.
Orders paid by bank transfer are shipped once the funds have cleared.
3.5 Retention of title and invoicing
Products remain our property until the price has been paid in full. Risk of loss and damage passes to you on delivery.
Your invoice is available in your account area, under "My orders".
4. Shipping and delivery
4.1 Dispatch times
Confirmed and paid orders are picked and handed to the carrier within 24 to 48 working hours. The transit time that follows depends on the carrier and on the destination chosen at checkout.
Stated times are indicative and run from the moment payment clears.
4.2 Delivery costs
They are calculated in the basket according to destination, weight and the shipping method chosen, and displayed before the order is confirmed.
4.3 Receiving the parcel and noting reservations
Check the condition of the parcel while the driver is present. If the packaging is open, crushed or damp, photograph it before opening.
If anything is damaged or missing, write precise, detailed reservations on the delivery note — "subject to unpacking" carries no weight — confirm them to the carrier within three (3) working days as required by Article L133-3 of the French Commercial Code, and tell us at the same time.
4.4 Late or failed delivery
If the order is not delivered by the agreed date, a consumer may, after instructing us to deliver within a reasonable further period and receiving no response, terminate the contract in writing under Articles L216-6 and L216-7 of the Consumer Code. Sums paid are then refunded within fourteen (14) days.
5. Commercial warranty — repair parts
5.1 Duration and scope
The repair parts we sell — LCD, In-Cell and OLED screens, batteries, connectors and other components — carry a 90-day commercial warranty against manufacturing defects, running from the date the order is received.
Where a product page states a different warranty period, that period is the one that applies.
5.2 What is covered
- Touch faults: no response, dead zones, ghost touches, long drags that break off.
- Display faults: dead pixels, blotches, failed or uneven backlight, lines present from the very first power-up.
- Any other manufacturing defect that makes the part unfit for its intended use.
The fault must be observed on a device that is otherwise in good working order, and reported within the warranty period.
5.3 What is excluded
- Broken, cracked or shattered screens, whatever the cause.
- Lines, streaks or blotches appearing after an impact, pressure, a pinched flex cable or mishandling.
- Damage caused by improper installation, handling or use.
- Liquid damage, corrosion, over-voltage or electrostatic discharge.
- Any modified part: glue or adhesive applied, chemicals, sanding, glass transfer, refurbishing.
- Removal, erasure or alteration of the labels, codes or inspection markings we apply.
- Normal wear, including the gradual capacity loss of a battery.
5.4 Cases where no commercial exchange can be granted
No exchange under the commercial warranty is possible where the screen is broken or cracked, where lines have appeared after physical damage, where glue or adhesive has been applied after purchase, or where the inspection marking has been removed: in those situations the origin of the fault can no longer be established.
5.5 How to claim
The return procedure, the evidence to supply and who bears the cost are set out in article 11.
This commercial warranty is in addition to the statutory guarantees in article 9: it does not replace them and cannot reduce them.
6. Service Packs — sold "as is"
6.1 No commercial warranty
Service Packs are sold with no commercial warranty, express or implied, as to their functionality, quality or durability. By ordering one, you accept it exactly as the manufacturer packaged it.
6.2 Why this exclusion
A Service Pack is a genuine assembly, sealed at the factory. We can neither open nor test it without breaking the seal, which would destroy the very thing that gives it its value. We therefore resell it in the exact condition in which we received it, without having been able to inspect the contents.
6.3 Opening the seal
Once the box is open, no exchange is possible, even if the part is genuine: from that moment it is exposed to factors beyond our control — handling, electrostatic discharge, humidity, fitting.
6.4 Exception: wrong reference supplied
If we ship a reference other than the one you ordered, or the product page stated the wrong compatibility, you are entitled to an exchange or a refund, on the following conditions:
- The product is unopened and its factory seal is intact.
- You report the problem within fourteen (14) days of receipt.
- Proof of purchase — invoice or order number — is provided.
A reference chosen in error when ordering falls, for a consumer, under the right of withdrawal (article 10) rather than this exception. Check compatibility before ordering: see article 12.
7. Mobile phones
The phones we sell — iPhone, Samsung, Xiaomi, Oppo and other brands — are covered by the manufacturer's warranty, on the terms and for the period that manufacturer sets. We grant no additional commercial warranty on these devices.
A manufacturer warranty claim is made to the brand or one of its authorised repairers, on production of the invoice. We will provide any proof of purchase needed, including the IMEI, on request.
The statutory guarantees in article 9 remain owed by us as the seller, whatever the extent of the manufacturer's warranty.
8. Accessories
8.1 Unbranded lines
Cables, chargers, adapters, headphones, hubs and other accessories without a third-party brand carry a six (6) month commercial warranty against manufacturing defects, running from receipt.
8.2 Major-brand accessories
Accessories from brands such as JBL, Sony, Xiaomi, Samsung or Apple are covered by their manufacturer's warranty alone, on that manufacturer's terms. Claims should be addressed to the brand.
8.3 Exclusions
- Physical damage: severed cable, torn sheath, bent or broken connector, cracked case, crushed earphones.
- Corrosion, liquid damage, over-voltage.
- Use contrary to the product's purpose or to the manufacturer's instructions.
- Normal wear of materials, particularly sheaths and connectors.
9. Statutory guarantees
Regardless of any commercial warranty, and whatever the range concerned, we remain bound to consumers by the following statutory guarantees.
9.1 Legal guarantee of conformity
Articles L217-3 et seq. of the French Consumer Code. It applies for two (2) years from delivery of the goods.
- You choose between repair and replacement, free of charge; return costs are ours to bear.
- For new goods, any lack of conformity appearing within twenty-four (24) months is presumed to have existed at the time of delivery: you do not have to prove it.
- If repair and replacement are both impossible, you may obtain a price reduction or rescission of the sale with a refund.
- Goods replaced under this guarantee start a fresh statutory guarantee period; bringing goods into conformity by repair extends it by six (6) months.
9.2 Guarantee against hidden defects
Articles 1641 to 1648 of the French Civil Code. It covers hidden defects that make the goods unfit for their purpose or substantially reduce their use, and allows you to obtain a refund of the price or a reduction. The claim must be brought within two (2) years of discovering the defect.
9.3 What the statutory guarantees do not cover
Damage arising after delivery and attributable to the customer: breakage, impact, liquid contact, improper installation, gluing or any other modification of the product. These are not defects existing at the time of delivery.
No provision of these Terms can remove or reduce these statutory guarantees. They remain available to you even where the commercial warranty does not apply, including on Service Packs and phones.
10. Right of withdrawal
This article is addressed to consumers. It does not apply to purchases made for the purposes of a business.
10.1 Period
You have fourteen (14) days from receipt of the last item in your order to withdraw, without giving a reason and without penalty (Article L221-18 of the Consumer Code).
10.2 How to exercise it
Send us an unambiguous statement before the period expires, by email to taqwaservices2021@gmail.com or by post to our registered address, quoting your order number and the references concerned. We will acknowledge receipt.
10.3 Returning the goods
Return the goods no later than fourteen (14) days after telling us of your decision. They must be complete, in their original packaging and, for Service Packs, with the seal intact.
Return shipping costs are yours to bear, in accordance with Article L221-23 of the Consumer Code.
10.4 Refund
We refund you no later than fourteen (14) days after recovering the goods or receiving proof of their dispatch, whichever is earlier. The refund covers the price of the goods and the standard outbound delivery charge, and is made to the payment method used for the order.
You remain liable for any diminished value resulting from handling beyond what is necessary to establish the nature and proper functioning of the product.
10.5 Statutory exclusions
The right of withdrawal does not apply to, among others, unsealed goods that cannot be returned for reasons of hygiene or health protection — such as in-ear headphones whose packaging has been opened — or goods made to your specifications or clearly personalised (Article L221-28 of the Consumer Code).
11. Returns, exchanges and warranty claims
11.1 Opening a claim
Contact customer service by email at taqwaservices2021@gmail.com or by phone on 09 51 82 16 70, quoting:
- Your order number and the product reference.
- A precise description of the fault.
- Photographs or, preferably, a short video showing the fault on a device in good working order.
We then give you a return number. It must appear on the parcel: a shipment received without one may be refused.
11.2 Conditions for acceptance
- The claim is made within the period applicable to the range concerned.
- Proof of purchase is provided.
- The product is returned complete, in its original packaging where possible.
- Inspection labels and markings are intact.
11.3 Who pays for the return
- Legal guarantee of conformity: costs are ours, and a prepaid label is provided.
- Withdrawal: return shipping costs are yours.
- Commercial warranty: the return leg is yours, the reshipment of the replacement is ours.
Use a tracked and, for valuable items, insured service: we cannot compensate for a parcel lost or damaged on its way to us.
11.4 Processing
The product is inspected by our workshop on arrival, normally within five (5) working days. We email you the result of that inspection.
If the fault is confirmed and covered, the product is replaced with an identical new item; failing stock, with an equivalent item, or refunded where no replacement is possible. If the fault is not found or falls under an exclusion, the product is returned to you and the reshipment cost is yours.
Refunds are issued to the original payment method.
12. Your responsibilities
Repair parts are intended to be fitted by someone with the necessary skills and tools. It is for you to:
- Check before ordering that the reference matches your device exactly: model, variant and market can each require a different reference. If in doubt, contact us before buying.
- Keep a Service Pack sealed for as long as you are considering a return — opening it cannot be undone.
- Test the part before any permanent gluing, on a device whose remaining hardware is working.
- Work with antistatic protection and disconnect the battery before starting.
- Never apply glue or adhesive before confirming that the part works: doing so makes any return impossible.
- Follow the safety rules for lithium batteries — do not pierce, bend, crush or expose them to heat — and dispose of replaced components through the WEEE collection scheme.
- Back up the data on the device before any work is carried out.
13. Limitation of liability
We are not liable for damage arising from:
- Improper installation, handling or use of the product.
- Physical damage caused after delivery, such as a broken screen or a severed cable.
- The application of glue, adhesives or chemicals to the product.
- Unauthorised modifications or repairs.
- Loss of data held on the device into which the part is fitted.
Towards business customers, our liability is limited to the net amount of the order concerned and excludes all indirect loss, in particular loss of business, loss of customers and loss of profit.
Nothing in this article limits our liability for wilful misconduct, gross negligence or personal injury, or restricts the statutory guarantees owed to consumers.
14. Intellectual property and third-party brands
The structure of taqwaservice.fr, its text, photographs, illustrations, logos and databases are protected. Any reproduction, extraction or reuse, in whole or in part, without our written permission is prohibited.
Third-party brands and model names — Apple, Samsung, Xiaomi, Oppo and others — are quoted solely to identify the devices our products are compatible with.
Taqwa Services is neither affiliated with these manufacturers nor an authorised reseller, unless a product page says otherwise. Parts not described as "Service Pack" are not genuine manufacturer parts.
15. Personal data
The data collected when you create an account and place an order is used to process and deliver the order, issue the invoice, provide after-sales service and, with your consent, send you commercial information.
It is processed on the basis of performance of the contract, our legal obligations — notably keeping invoices for ten (10) years — and, where applicable, your consent. It is shared only with the providers needed for those purposes: carrier, payment provider, host.
Under the General Data Protection Regulation you have rights of access, rectification, erasure, restriction, objection and portability, which you can exercise at taqwaservices2021@gmail.com. You may also lodge a complaint with the French data protection authority (CNIL).
16. Governing law and disputes
These Terms and the sales they govern are subject to French law.
If a problem arises, please first send a written complaint to our customer service at taqwaservices2021@gmail.com: the great majority of disputes are settled at that stage.
Under Article L612-1 of the French Consumer Code, every consumer has the right to use a consumer mediator free of charge to seek an amicable settlement of a dispute with a trader. The details of the mediator we are registered with appear on our invoices and are provided on request.
Failing an amicable settlement, a consumer may bring proceedings before any court available under the French Code of Civil Procedure, including the court for the place where they lived when the contract was concluded. Disputes with business customers fall within the exclusive jurisdiction of the courts of Paris.
